A trademark is any distinctive sign, word, phrase, logo, symbol, shape, colour, or combination thereof that identifies and distinguishes the goods or services of one business from those of another. In India, trademarks are governed by the Trade Marks Act, 1999 and the Trade Marks Rules, 2017. Once registered, a trademark gives the owner the exclusive right to use it in connection with the goods or services for which it is registered — and the right to prevent others from using identical or confusingly similar marks.
The following can be registered as trademarks in India:
•Words (including personal names, surnames, place names)
•Logos and device marks
•Slogans and taglines
•Numerals
•Combination of colours
•Three-dimensional shapes (3D marks)

•Collective marks
India follows the Nice Classification system, under which goods and services are divided into 45 classes — Classes 1 to 34 for goods and Classes 35 to 45 for services. A trademark application must specify the relevant class(es). Veralex conducts a thorough analysis of your business to identify the correct and most strategic classes for registration.

Any person or legal entity — individual, company, partnership firm, trust, or any other organization — claiming to be the proprietor of a trademark used or proposed to be used in India can apply for registration.


We search the Trade Marks Registry database to identify identical or similar marks and assess registrability.

Based on your business activities, we identify the appropriate Nice Classification class(es).

We prepare the trademark application with precise specifications of goods/services.

We file the application on the Trade Marks Registry portal. Upon filing, a TM-A number is issued.

24.The Registry examines the application and may issue an Examination Report (ER) raising absolute or relative grounds of refusal.

Veralex prepares a detailed response addressing all objections raised.

If accepted, the mark is advertised in the Trade Marks Journal for a period of four months for opposition.

27.Any third party may oppose the registration within four months. Veralex represents you in opposition proceedings.

28.If no opposition is filed or opposition is dismissed, the trademark is registered, and a Certificate of Registration is issued.

A trademark protects a brand name or logo in relation to specific goods/services. A trade name is a business name registered with the Registrar of Companies or other authority.
