What is a Design Under Indian Law?

Under the Designs Act, 2000, a 'design' means only the features of shape, configuration, pattern, ornament, or composition of lines or colours applied to any article, whether in two-dimensional or three-dimensional form, or in both forms. These features must be applied to an article by any industrial process — and must appeal to and be judged solely by the eye. Importantly, design protection covers the visual appearance of a product — not how it works or functions (that is the domain of patents).

Term of Design Registration & Renewal

A registered design in India is initially valid for 10 years from the date of registration, extendable by a further period of 5 years on payment of the prescribed renewal fee — for a total maximum protection period of 15 years.
