A Geographical Indication (GI) is an indication that identifies a product as originating from a specific geographical territory of a country, region, or locality, where a given quality, reputation, or other characteristic of the product is essentially attributable to its geographical origin.
In India, GIs are governed by the Geographical Indications of Goods (Registration and Protection) Act, 1999 and the Geographical Indications of Goods (Registration and Protection) Rules, 2002. The GI Registry is located in Chennai.

Under the GI Act, an application for GI registration can be made by:
•Any association of persons, producers, or organization or authority established by or under any law for the time being in force representing the interests of the producers of the concerned goods.
•It can be a producer association, a cooperative, an NGO, a State Government, or any other organization representing the producers.
Individual producers cannot apply — the applicant must be a collective body representing the producers in the geographical region.

Any person claiming to be the producer of goods in respect of which a GI has been registered may apply to be registered as an Authorized User. A trademark identifies the commercial source of a product (a particular company or brand). A Geographical Indication identifies that a product originates from a specific geographical location and possesses qualities attributable to that origin. Trademarks are owned by individuals or companies; GIs belong to the community of producers of the region. Importantly, a GI-registered name cannot be registered as a trademark by any individual.
Registration is not mandatory for the product to be sold, but without GI registration, there is no legal protection against misuse of the name by producers outside the region. Registration provides the legal teeth to prevent unauthorized use and take infringers to court.
A GI registration is valid for 10 years from the date of application and is renewable for further periods of 10 years each, indefinitely.
Yes. Foreign Geographical Indications can be registered in India under the GI Act, provided they are already protected in their country of origin. This is particularly relevant for products like Scotch Whisky, Champagne, and Cognac.
Infringement of a registered GI is both a civil and criminal offence in India. The registered proprietor can seek civil remedies — injunction, damages — and the infringer may also face criminal prosecution with imprisonment up to 3 years and fines. Yes. Producers who are Authorized Users of a GI can have their own individual trademarks for their brand, distinct from the GI tag. The GI protects the origin; the trademark protects the individual producer's commercial identity.
