What is a Trademark?

A trademark is any distinctive sign, word, phrase, logo, symbol, shape, colour, or combination thereof that identifies and distinguishes the goods or services of one business from those of another. In India, trademarks are governed by the Trade Marks Act, 1999 and the Trade Marks Rules, 2017. Once registered, a trademark gives the owner the exclusive right to use it in connection with the goods or services for which it is registered — and the right to prevent others from using identical or confusingly similar marks.

Classes of Trademarks in India

India follows the Nice Classification system, under which goods and services are divided into 45 classes — Classes 1 to 34 for goods and Classes 35 to 45 for services.
